Welcome to BekaaSoft. Please read these Terms of Service carefully before using our services. By visiting our website and using our services, you agree to the terms below.

1. Parties and Scope

These Terms of Service ("Terms") govern the rights and obligations relating to the website design, development, hosting and related digital services ("Services") provided by BekaaSoft ("Company", "we") through the bekaasoft.com.tr domain. Any individual or legal entity who visits our website, creates an account, or purchases a service ("User", "Customer") is deemed to have read and accepted these Terms.

2. Description of Services

We provide the design, development and deployment of corporate websites, e-commerce sites, landing pages and similar digital products on the customer's preferred infrastructure — primarily Cloudflare, and optionally cPanel/PHP, static HTML or WordPress. The scope of each service is defined by the selected package and the agreement reached with the customer.

3. Orders, Packages and Project Process

Package contents, page counts, revision rights and support periods are stated on the relevant package page. After ordering, the customer is asked to complete a project brief. Fields left blank by the customer may be completed at the Company's professional discretion to keep the project moving. The project is carried out phase by phase within the agreed scope.

4. Payment Terms

Service fees are charged at the prices in effect at the time of the order, through the Shopier secure payment infrastructure. Unless otherwise stated, prices exclude VAT and payments are one-time. For license products (e.g. LeadMap), the fee is collected in full at the time of purchase.

5. Customer's Obligations

The customer is responsible for providing site content, images, text and brand materials, and for declaring that they hold the rights to use such materials. Any liability arising from content that infringes third-party intellectual property rights rests solely with the customer. Domain and DNS/nameserver changes are performed by the customer, with the Company's guidance where needed.

6. Delivery and Go-Live

Upon completion, the nameserver or hosting details required to go live are provided to the customer. The Company cannot be held responsible for technical delays beyond its control, such as DNS propagation time. After delivery, the support and revision rights included in the package apply.

7. Intellectual Property

The BekaaSoft brand, logo, website design and proprietary software components belong to the Company. Usage rights to the delivered project are transferred to the customer upon full payment. The Company reserves the right to use completed work for reference/portfolio purposes in its promotions.

8. Limitation of Liability

Services are provided "as is". The Company cannot be held responsible for interruptions, errors or data losses originating from third-party providers (Cloudflare, Resend, SMS providers, payment institutions, etc.). The Company's total liability is in all cases limited to the fee paid for the relevant service. The Company is not liable for indirect, incidental or loss-of-profit damages.

9. Cancellation and Refund

For projects where production has started, an assessment is made by deducting the effort spent and completed work items. For digital license products, no refund is possible once the code has been delivered, as the product is deemed used. Refund and cancellation requests are submitted to info@bekaasoft.com.tr.

10. Privacy and Personal Data

Your personal data is processed in accordance with the principles set out in our Privacy Policy. Please review the Privacy Policy for details.

11. Changes to the Terms

The Company reserves the right to update these Terms at any time. Updated Terms take effect upon publication on the website. Continuing to use the Services means you accept the current Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. The Courts and Enforcement Offices of İzmir have jurisdiction over any disputes arising from these Terms.
